Agreement to Terms

These Terms of Service govern your use of the Tropical Design Nutrition website, products, related services, and our affiliate program. By accessing our site, purchasing from us, or applying to become an affiliate, you agree to be bound by these terms.

If you do not agree, you must not use our services or participate in the affiliate program.

Products & Orders

Product descriptions, pricing, and availability are subject to change without notice. We reserve the right to limit quantities or refuse orders.

You are responsible for providing accurate account, shipping, and payment information. Risk of loss passes to you upon delivery to the carrier unless otherwise required by law.

Subscriptions & Auto-Renewal

Some products may be offered on a subscription or auto-renewal basis. When you select a subscription option at checkout, you authorize Tropical Design Nutrition and our payment processor to charge your selected payment method on a recurring schedule disclosed at checkout (for example, every 7 or 30 days, as shown for the product).

Subscription pricing, billing frequency, and any applicable subscription discounts will be displayed before you complete your purchase. By placing a subscription order, you agree to recurring charges until you cancel.

You may cancel an active subscription at any time through your customer account or by contacting customer support. Cancellation stops future billing but does not automatically refund prior charges unless required by law or covered under our Refund Policy.

We may change subscription pricing, intervals, or program availability with reasonable notice where required. If a payment fails, we may retry the charge or suspend the subscription until a valid payment method is provided.

Refund Policy

We want you to be satisfied with your purchase. Refunds and returns for orders placed directly on our website are handled according to this Refund Policy and our separate Returns Policy, which is incorporated into these Terms by reference.

Due to the nature of health and nutritional products, strict hygiene and safety standards apply. Eligible items must generally be unopened, unused, and sealed in original packaging. Opened or partially used consumable products (including drinks and supplements) are not eligible for return or refund, except where the item is defective, damaged, incorrect, or expired upon delivery.

Return requests must be submitted within seven (7) days of the delivery date shown on your tracking information, unless otherwise required by applicable consumer protection laws. You may initiate a return through your customer account order history or by contacting support with your order number.

If a product is delivered expired, damaged, defective, or incorrect, you may be eligible for a full refund or replacement after verification. Approved refunds are processed to the original payment method within a reasonable timeframe, depending on your payment provider.

Original shipping fees are non-refundable except where required by law or where the return is due to our error. Products purchased from third-party retailers are subject to those retailers' return and refund policies.

Acceptable Use

You agree not to misuse the site, interfere with security, attempt unauthorized access, scrape content in violation of these terms, or use our services for unlawful purposes.

Health & Product Information

Statements about our nutritional products have not been evaluated by the Food and Drug Administration unless expressly stated otherwise on the product or labeling where applicable. Products are not intended to diagnose, treat, cure, or prevent any disease.

Consult a qualified healthcare professional before beginning any supplement regimen, especially if you are pregnant, nursing, taking medication, or have a medical condition.

Affiliate Program Overview

Our affiliate program allows approved participants to earn commissions by referring customers to Tropical Design Nutrition using unique referral links or codes provided through the affiliate dashboard.

Participation in the affiliate program is voluntary and subject to our approval. Submitting an application does not guarantee acceptance. We may approve, deny, suspend, or terminate any affiliate account at our sole discretion.

By applying to or participating in the affiliate program, you also agree to the affiliate-specific terms outlined in this document.

Affiliate Enrollment & Account Status

To join, you must submit a complete application with accurate information. If you already have a customer account, you may apply using the same account; we do not require a separate login for affiliate participation.

New affiliate accounts are created with a pending status until reviewed and approved by our team. While pending, you may access portions of the affiliate dashboard, but commission-generating features may be limited until your account is active.

We may request additional information before approval and may suspend or terminate an affiliate account for inactivity, policy violations, fraud, misleading promotion, or any conduct that harms our brand or customers.

Referral Links, Tracking & Commissions

Approved affiliates receive unique referral codes or links for use in permitted promotional activities. Commissions are tracked through referral attribution methods such as referral parameters, links, and cookies, as configured in our system.

A commission is earned only when a qualifying purchase is completed by a referred customer and is correctly attributed to your affiliate account under our program rules. Commission rates, eligible products, and payout thresholds may change and will be reflected in your affiliate dashboard or program settings.

We do not guarantee any level of earnings. Commissions may be withheld, reversed, or adjusted for cancelled orders, refunds, chargebacks, duplicate accounts, invalid traffic, or orders that do not meet program requirements.

If self-referral prevention is enabled, purchases made using your own referral link or code will not generate commissions. Affiliates must not attempt to circumvent attribution, tracking, or anti-fraud controls.

Affiliate Promotion Rules

You must promote our products honestly and accurately. You may not make false, exaggerated, or unsubstantiated health claims, imply medical endorsement, or misrepresent your relationship with Tropical Design Nutrition.

You may not use spam, unsolicited messages, trademark bidding on our brand name without permission, cookie stuffing, fake traffic, incentive-based clicks that violate platform rules, or any deceptive or fraudulent marketing practices.

You are responsible for ensuring your promotional content complies with applicable advertising laws and platform policies, including disclosure of your affiliate relationship where required (for example, using clear statements such as "affiliate link" or "I may earn a commission").

Affiliate Payouts

Payouts are available only to affiliates with active accounts who meet the minimum balance and verification requirements shown in the dashboard. You must provide accurate payout details for the payment methods we support.

Payout requests are subject to review and may be delayed or denied if we suspect fraud, policy violations, incomplete tax or identity information, or unresolved commission disputes.

You are solely responsible for any taxes, reporting obligations, or fees associated with affiliate earnings in your jurisdiction.

Limitation of Liability

To the fullest extent permitted by law, Tropical Design Nutrition and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or website.

Our total liability for any claim arising out of these terms or your purchase shall not exceed the amount you paid us for the specific product or order giving rise to the claim.

Governing Law

These terms are governed by applicable laws without regard to conflict-of-law principles. Disputes shall be resolved in the courts located in the jurisdiction we designate in writing, unless a mandatory consumer protection law requires otherwise.
